These Terms and Conditions ("Terms") govern your access to and use of TheWhiteningStore.com (the "Site") and purchases made from The Whitening Store LLC ("The Whitening Store," "we," "us," or "our").

By accessing the Site, creating an account, or placing an order, you agree to these Terms and to any policies incorporated into them by reference, including our Privacy Policy, Cookie Policy, Shipping & Returns Policy, and any product-specific terms or instructions provided on the Site.

If you do not agree to these Terms, you should not use the Site.

Nothing in these Terms is intended to limit or exclude consumer rights that cannot legally be waived under applicable law.

Eligibility to use the Site

You must be legally capable of entering into a binding agreement in your jurisdiction to make purchases through the Site.

Certain products may be intended only for adults or professional use. Product-specific eligibility or professional-use requirements will be identified where applicable.

You are responsible for ensuring that your purchase, possession, use, or professional application of any product complies with laws and regulations applicable in your location.

Products and product information

We make reasonable efforts to describe our products accurately, including product specifications, ingredients, intended uses, quantities, colors, packaging, and other characteristics.

However, packaging, labeling, product appearance, specifications, or availability may change from time to time without materially changing the product.

Images are provided for illustrative purposes and may appear differently depending on your device or display settings.

We reserve the right to correct typographical errors, inaccuracies, or omissions and to update product information at any time.

Product availability and order acceptance

All orders are subject to product availability and acceptance by The Whitening Store.

Submitting an order does not guarantee acceptance. We may refuse, cancel, or limit an order where reasonably necessary, including in cases involving:

• suspected fraud or unauthorized payment;
• incorrect pricing or product information;
• inventory errors;
• shipping restrictions;
• suspected resale or diversion contrary to these Terms;
• regulatory or legal restrictions;
• unusually high order quantities; or
• other circumstances that make fulfillment impracticable or unlawful.

If we cancel an order after payment has been collected, we will provide an appropriate refund for the cancelled portion.

Prices and payment

Prices are displayed in the currency shown on the Site and may change without notice.

Applicable taxes, shipping charges, duties, or other fees may be calculated or disclosed during checkout where available.

You agree to provide current, complete, and accurate billing and payment information.

Payments are processed through Shopify and authorized payment providers. Additional terms from those payment providers may apply.

Changing or cancelling an order

We begin processing orders promptly.

If you need to request an order change or cancellation, please contact us as soon as possible. We cannot guarantee that an order can be changed or cancelled once fulfillment has begun or the order has shipped.

Nothing in this section limits any statutory cancellation or withdrawal right that applies to you under applicable consumer law.

Customers are responsible for providing a complete and accurate shipping address at checkout. Additional shipping charges resulting from an incorrect or incomplete address may be the customer's responsibility where permitted by law.

Order processing

Orders are generally processed on business days, Monday through Friday, excluding holidays.

Most standard orders are typically prepared for shipment within approximately 2–5 business days.

Professional lamps, business packages, first-time wholesale orders, high-volume orders, or other designated products may require approximately 7 business days before shipment.

Processing times are estimates and are separate from carrier transit times.

If a material fulfillment delay occurs, we may contact you regarding the order.

Domestic shipping

Shipping methods, estimated carrier transit times, and available rates are displayed at checkout when available.

Tracking information is generally provided after shipment.

Carrier transit times are estimates and are not guaranteed unless expressly stated by the applicable carrier or shipping service.

Once a parcel is accepted by the carrier, delivery may be affected by weather, carrier operations, transportation disruptions, address issues, holidays, or other events outside our reasonable control.

Nothing in this section limits rights you may have under applicable law if goods are not delivered.

International shipping

International shipping availability varies by destination and product.

Customers are responsible for ensuring that products may lawfully be imported into, possessed, or used in their destination country.

International shipments may be subject to customs duties, import taxes, brokerage charges, VAT, handling fees, or other governmental charges. Unless otherwise stated at checkout or required by applicable law, these charges are the responsibility of the recipient.

Customs authorities may require us to disclose accurate product descriptions, quantities, and values. We will not falsify customs declarations or reduce declared values at a customer's request.

Customs clearance or other border procedures may delay delivery.

If an international shipment is rejected, abandoned, refused, or returned because duties or taxes were not paid, the address was incorrect, import requirements were not satisfied, or delivery was refused, any refund or reshipment will be handled in accordance with applicable law and our Shipping & Returns Policy.

Returned-to-sender shipments

If a shipment is returned to us because of an incorrect or incomplete address, refusal of delivery, unpaid customs charges, failure to collect the shipment, or another circumstance attributable to the recipient, we may contact you to determine whether reshipment is appropriate.

Where permitted by applicable law, the customer may be responsible for additional postage or carrier charges required to resend the order.

Original shipping costs may be non-refundable where those charges have already been incurred and applicable law permits.

Professional lamps and business packages

Professional lamps, business packages, and certain high-value professional products may be subject to additional fraud-prevention or address-verification procedures.

We may require shipment to a verified billing address or request additional confirmation before fulfillment.

If we are unable to verify the transaction or destination satisfactorily, we may cancel and refund the affected order.

These products may require approximately 7 business days for processing before shipment.

Returns, exchanges, and store credit

Our standard voluntary return policy is described in our Shipping & Returns Policy and is incorporated into these Terms.

For customers in the United States, eligible unopened products may generally be returned within 30 days of delivery for exchange or store credit, subject to the conditions and exclusions stated in our Shipping & Returns Policy.

Products that have been opened, unsealed, used, altered, damaged after delivery, or otherwise made unsuitable for resale may be ineligible for voluntary return.

Shipping charges are generally non-refundable except where required by law or where we expressly agree otherwise.

Nothing in our voluntary return policy limits rights or remedies available for defective, damaged, incorrectly supplied, or nonconforming goods under applicable law.

International consumer withdrawal rights

Customers located in certain jurisdictions, including the European Economic Area, may have statutory rights to cancel or withdraw from an online purchase within a specified period.

Where applicable, those statutory rights apply regardless of any narrower voluntary return policy stated elsewhere on the Site.

For eligible EU consumer purchases, the statutory withdrawal period is generally 14 days after delivery of the goods, subject to applicable exceptions.

Certain products may be exempt once opened or unsealed where they are not suitable for return for health-protection or hygiene reasons.

Where required by law, eligible consumers may exercise withdrawal rights through the method or functionality provided on the Site or by contacting us.

The customer may be responsible for return shipping costs where permitted by applicable law and where properly disclosed before purchase.

Nothing in these Terms restricts statutory consumer rights that apply in the customer's jurisdiction.

Damaged, defective, or incorrect items

Please inspect your order after delivery.

If an item arrives damaged, defective, or materially different from what you ordered, contact us promptly with your order number and reasonable supporting information, which may include photographs or video where appropriate.

We may offer replacement, correction, refund, or another remedy depending on the circumstances and applicable law.

Product use and safety

Products must be used, handled, and stored in accordance with the labeling, instructions, warnings, product descriptions, and other guidance provided with the product or on the Site.

You are responsible for reviewing product information before use and determining whether a product is appropriate for its intended application.

Results vary between individuals, and we do not guarantee a particular whitening result, shade improvement, treatment outcome, or duration of results unless expressly stated in writing.

Teeth whitening products may cause temporary tooth sensitivity, gum irritation, or other reactions in some users.

Do not use products in a manner inconsistent with their instructions, labeling, intended use, or applicable professional requirements.

To the fullest extent permitted by law, The Whitening Store and product manufacturers are not responsible for harm resulting from misuse, improper application, unauthorized modification, improper storage, failure to follow directions or warnings, or use for an unintended purpose.

Nothing in this section excludes liability that cannot legally be excluded.

Professional-use products

Certain products sold through the Site are intended for use by dental professionals, teeth-whitening professionals, trained providers, or businesses.

Purchasers of professional products are responsible for determining whether they have the training, qualifications, licenses, permits, insurance, supervision, or other authorization required by law in their jurisdiction.

The availability of a product for purchase from our Site does not constitute a representation that the purchaser is legally authorized to provide any particular service.

Professional purchasers are responsible for their own client screening, informed consent procedures, operating procedures, sanitation practices, regulatory compliance, and professional services.

Information, instructions, training materials, or educational content provided by The Whitening Store are general informational resources and do not constitute legal, medical, dental, licensing, or regulatory advice.

Unauthorized resale

Products are sold for personal use, professional use within the purchaser's business, or authorized wholesale/resale purposes.

You may not resell, divert, repackage, relabel, materially alter, distribute through unauthorized marketplaces, or otherwise commercially redistribute our products unless The Whitening Store has expressly authorized that activity.

Authorized wholesale or resale customers remain subject to any separate wholesale, distribution, brand, marketplace, or resale terms communicated to them.

Intellectual property

The Site and its original content, including text, graphics, photographs, product images, logos, trademarks, designs, videos, downloads, and other materials, are owned by or licensed to The Whitening Store and are protected by applicable intellectual-property laws.

White in Minutes® and associated branding are proprietary marks of The Whitening Store or its licensors.

You may access and use the Site for personal or legitimate business purchasing purposes.

You may not reproduce, republish, distribute, modify, sell, license, exploit, scrape for commercial republication, or otherwise use protected Site content for commercial purposes without our prior written permission, except where applicable law permits such use.

Reviews and other customer content

The Site may allow customers to submit reviews, ratings, photographs, videos, comments, feedback, or similar material.

You are responsible for content you submit and represent that you have the right to provide it.

Submitted content must not be knowingly false, defamatory, unlawful, threatening, discriminatory, infringing, fraudulent, or misleading.

By submitting content for publication, you grant The Whitening Store a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, adapt for formatting, and use that content in connection with operating, promoting, and marketing our business and products.

You retain ownership of intellectual-property rights you hold in your content.

We may moderate, decline, or remove submitted content where reasonably appropriate, including content that violates these Terms, applicable law, platform policies, or review-integrity standards.

Acceptable use of the Site

You may not use the Site to:

• violate applicable law;
• commit or facilitate fraud;
• interfere with Site security or operation;
• attempt unauthorized access to accounts, systems, or data;
• introduce malicious code or harmful technology;
• scrape or systematically extract Site content for unauthorized commercial purposes;
• impersonate another person or provide materially false information;
• infringe intellectual-property or privacy rights;
• harass or threaten others;
• abuse customer-support systems; or
• engage in activity that materially interferes with other users' ability to use the Site.

We may restrict or terminate access where reasonably necessary to protect the Site, customers, our business, or third parties.

Third-party services and links

The Site may contain links to or integrate services provided by third parties, including payment providers, shipping services, social platforms, review services, and other ecommerce technologies.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for third-party websites or services that are outside our control, except to the extent responsibility cannot legally be excluded.

Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy.

Our use of cookies and similar technologies is described in our Cookie Policy.

Those policies are incorporated into these Terms by reference.

Site availability

We aim to keep the Site available and accurate, but uninterrupted or error-free access cannot be guaranteed.

We may modify, suspend, maintain, or discontinue Site functionality where reasonably necessary.

We are not responsible for temporary interruptions caused by maintenance, technical issues, third-party providers, telecommunications systems, events outside our reasonable control, or similar circumstances, except where applicable law provides otherwise.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an "as available" basis.

We do not guarantee that the Site will always be uninterrupted, error-free, secure, or free from harmful components.

Product warranties, consumer guarantees, and statutory rights that cannot legally be excluded remain unaffected.

Limitation of liability

To the fullest extent permitted by law, The Whitening Store will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the Site.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including any liability that cannot lawfully be waived under applicable consumer-protection law.

Any limitations stated in these Terms apply only to the extent permitted in the jurisdiction governing the particular claim.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold The Whitening Store harmless from third-party claims, damages, liabilities, and reasonable expenses resulting from your unlawful use of the Site, infringement of another person's rights, misuse of products, or material violation of these Terms.

This provision does not apply to claims resulting from our own conduct where applicable law makes such indemnification unavailable.

Events outside our reasonable control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier interruptions, government actions, customs delays, labor disputes, telecommunications failures, supply disruptions, epidemics, or similar events.

This section does not limit rights or remedies that applicable law provides to consumers.

Electronic communications

When you use the Site, place an order, submit a form, or communicate with us electronically, you consent to receiving transactional communications electronically where permitted by law.

Transactional messages may include order confirmations, payment information, shipping notices, account communications, policy notices, and customer-service responses.

Marketing communications are governed separately and may be opted out of as described in our Privacy Policy and in the applicable communication.

Governing law

Except where mandatory consumer law provides otherwise, these Terms and disputes arising from them are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law principles.

Consumers located outside South Carolina may have mandatory rights under the laws of their place of residence. Nothing in this governing-law provision deprives a consumer of protections that cannot lawfully be waived.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as appropriate without affecting the validity of the remaining provisions.

No waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

Entire agreement

These Terms, together with policies expressly incorporated by reference and any additional terms applicable to a particular purchase or service, constitute the agreement governing your use of the Site and purchases made through it.

Changes to these Terms

We may update these Terms periodically to reflect changes to our Site, products, business practices, legal requirements, or policies.

When we update the Terms, we will revise the "Last updated" date.

Changes apply prospectively unless applicable law provides otherwise.
